Hiring Policy

In order for the PUBLICITY and / or CONTRACTED ACTIONS to be managed by DiViMEDiA or published on the collaborating media with DiViMEDiA, the advertiser or the company that, in its name, is responsible for the management of the campaign (s) ) and / or advertising actions subject to these conditions, accept the following contracting conditions and accept your legal responsibility for compliance with them.
1st - The company DiViMEDiA SL, with CIF B88465372 and domicile in Paseo de la Castellana, 91 - 4th Floor, Office 1, 28046 Madrid (hereinafter DiViMEDiA) will receive the PURCHASE ORDERS, in digital format via mail, specifying each and every one of the projects, concepts and / or actions that, as a whole, clearly identify the contracted activity, including:
to). Hiring period, support or format object of the order, including creativity.

b). If the creativity is carried out by DiViMEDiA, the administrative documentation of the campaign must include the acceptance of the creativity made by DiViMEDiA in a clear and reliable manner.

c). Period of issuance of the same or number of positive actions on creativity, action, structure created, launched or issued in the collaborating Partners of DiViMEDiA, as well as locations where the action is required to be mounted.

d). Economic conditions, including UNIT PRICE of the contracted format and total net amount of the campaign contracted without including VAT.

and). In the event that the contracted advertising is directed to one or more categories of those available for the segmentation thereof, these must be clearly specified, including the number of target units of each of them and, where appropriate, the particular budgets allocated to each category. This affects all the formats available in the DiViMEDiA Collaborating Partners.

F). In the case of the formats contracted under the “cost per click” formula for digital actions, the order must include the address or URL to which each of the creatives must be connected.

g). In the event that there has been a prior negotiation that sets particular or specific conditions that govern the campaign being hired, these must be explicitly specified.

h). In the case specified in point g, both parties undertake to maintain strict confidentiality over all the terms of the agreement, both in the public sphere and in that of the company itself or customers common to the contracting company.
2nd - General legal considerations:
to). The advertiser, and in his case the company that hires the campaign, undertake to comply with all the legal conditions required by the General Law of Advertising, Self-Control of Advertising and any other specific law to which the activity of the contracting company on the veracity of the messages issued.

b). Failure to comply with this legal validity or the filing of any claim from a duly supported party, will result in the immediate stoppage of the affected campaigns without this entailing any modification on the collection rights that affect the advertising already issued at the time of suspension. nor to the waiver of the exercise of legal actions in defense of the rights or responsibility of DiViMEDiA on the breach of the obligations of the advertiser or the company that, in its name, is responsible for the hiring.

c). DiViMEDiA, in compliance with the obligations subscribed in the commitments acquired with its collaborating Partners, will be especially sensitive in the fulfillment of the same in everything that affects the fulfillment of the current legality and with special attention, will monitor the messages considered threatening against the sensitivity of certain groups such as childhood, religion, race, sex and violence and regulated activities such as gambling, betting etc. However, it is the exclusive obligation of the brand to conform to the legal framework in which its authorized activities are exercised, expressly excluding DiViMEDiA from any responsibility for the content of the advertising served in the collaborating Partners.
3rd - Technical specifications of the announcements to be broadcast on the DiViMEDiA Online network of collaborators:
to). Creatives must conform, in size and weight, to each of the formats contracted according to the technical information provided.

b). The destination URLS may not be altered or modified without prior notice in this regard addressed to DiViMEDiA and approved in writing, being by email in support perfectly valid for them.
ISSUANCE OF CONTRACTED ADVERTISING
VOLUME:

DiViMEDiA cannot be responsible for the fulfillment of the contracted campaign volume, this result being the sum of factors that completely escape its scope of action.

The only source accepted for control over the number of clicks, impressions or any other contracted format will be offered by the DiViMEDiA technology platform.

DiViMEDiA cannot be responsible for technical or operational incidents in the collaborating Partners whose responsibility is to issue the programmed advertising in the terms and conditions included in these general conditions, in the Purchase Order and in the agreement signed between them and DiViMEDiA.
PAYMENTS:

Payments must be made, unless expressly agreed otherwise, within 30 days determined by the invoice date.
Billing will be monthly.

In case the campaign has an indefinite duration or covers more than one month, DiViMEDiA will invoice the amount resulting from the advertising issued in each of the months of its validity.

In case there are claims about the content of the invoice, the recipient will have a period of TEN WORKING DAYS, to make the corresponding claims and / or corrections. After this period, it will be understood that the invoice is correct and must be paid within the stipulated period.
ISSUANCE, MANAGEMENT AND REGULATION OF SELF-EXECUTING PROGRAMS OR “COOKIES”
The client undertakes to respect all the regulations required on this aspect, with special rigor in everything that refers to the collection of personal data or its dissemination in accordance with the provisions of the Data Protection Law and the Services Law of the Information Society and how many regulations, Autonomous, national or European, are in force at the time of hiring.
